I have been living in the Courts of the Fountain Apartments since November 27th of 2002. As much as I enjoyed the location and the rent pricing, the living conditions have been absolutely horrible. I am giving you a fourteen-day notice under the Residential Tenants Right to Repair Act to resolve the issues at hand and I believe I deserve compensation for my troubles and inconveniences.


As stated before, I have stayed in these apartments for over three years and the problems that I have encountered were absolutely ridiculous. My home has been torn up three times since I moved in. No serious complaints were filed with management or authorities because I did not want to cause problems with the lease renewal.


There were multiple incidents that occurred in my apartment and I want to be reasonably compensated for my losses incurred. About two years ago, I came home from school only to discover that my kitchen was completely torn up due to some piping work between my neighbors apartment and mine. This was NOT an emergency issue. According to Chapman v. Brokaw, 588 N.E.2d 462, 167 Ill. Dec. 821 (3rd 1992) I am entitled to the Covenant of Quiet and Enjoyment. This implies that I was supposed to have been given notice before entry to my apartment. I received no such notice. The work took two weeks to complete, including weekends, which meant that I did not have a kitchen for the time being, not to mention the inconvenience of having the repair person in my home every day of the week.


When the work was finally completed, all my clothes needed to be dry-cleaned from the dust and it took two days to put everything back in order. I placed a phone call to you explaining the situation and asking if I could at least have a half of months rent off. Your response was, Is this what they teach you kids in school these days, extorting money from people. Your response is not only rude and inappropriate, but also discriminating based on age according to the Cook County Human Rights Ordinance, No. 93-0-13.


Another incident occurred about a year ago. Upon coming home I saw my door open and my lights turned on. As I came closer to the apartment thinking I was being robbed, I saw your repairman by the entrance, with my carpet torn up in the hallway, in the closet, and part of my kitchen. Again, this was no emergency situation and I should have been notified prior to entry in accordance with the Covenant of Quiet and Enjoyment. It took a week to finish the work in the apartment, including the work that was being done on the weekends. Again all my clothes needed to be dry-cleaned and it took time to get the apartment in order.


The last serious incident occurred when your maintenance person Andrew put a hole through my ceiling in my bathroom and I could not take a shower for three days because the drywall kept coming down on the bathtub and clogging the drain. I had to shower in the model apartment. This has got to stop!!! As of today, the hole has yet to be fixed. As of now you are in breach of Warranty and Habitability laws.


My home is a mess due to your incompetence. The water in the bathroom sink hardly drains because it is extremely clogged up. The stove in the kitchen does not work properly as the burners dont light up well. My temperature control knob does not work at all, the cold air keeps coming into the apartment under both of my entrance doors, the wall around the ventilation duct in the bathroom is cracked and the duct is about to fall out, and even though complaints have been filed, no work has been done. The maintenance person is absolutely rude and walks in and out of my apartment as if it were his own. Your maintenance workers work past 7pm and early in the morning on Saturdays and Sundays when people are trying to rest. I am sick and tired of dealing with these issues.


I would like to be compensated for the amount of two months rent for cost resulting from dry-cleaning bills, and the food that I had to buy when my kitchen was torn up. I would also like a personal apology from you directly. I do not care to talk to anyone else about these matters but you. You have been extremely rude and I will NEVER recommend these apartments to anyone. If my demands are not met, I will be taking you to court!!! As previously stated, I am also giving you a fourteen-day notice to fix my stove, the hole in the bathroom ceiling, the temperature control knob, my sink, the entrance doors, and the wall around the ventilation duct in the bathroom. If these matters are not resolved by then, I will be forced to hire a maintenance person, file a complaint with the Housing Inspector, and file a complaint with the Illinois Tenant Union. If I should be found financially obligated to matters, which the management is responsible for, I will seek financial compensation by means of small claims court.
