Highly Unprofessional Management

On or around May 25, 2008, I was served with a Summons and Complaint seeking eviction by Dixon Mills Apartments for failure to pay rent on time for the months of May and June 2008. The court date would be June 12, 2008.

On June 9, 2008, I spoke to the Dixon Mills rental office. They verbally informed me that I was being evicted for:

1. habitual failure to pay rent on time
2. violation of lease: having someone live with me
3. damage to property

No notices to cease or quit were given to me for any of the above alleged violations.
To my knowledge there is nothing in writing regarding the above three items.
The damage to the property was minimal, and not intentional or grossly negligent. (Note to be evicted for damage to the property NJ state law says it must be intentional and groslly negligent and notices to quit must be served.)
DIXON MILLS DID NOT FOLLOW NJ LAW OR DUE PROCESS.

Additionally it should be pointed out that I have been unemployed since February 2007*. I was receiving HOPWA (rental subsidy for HIV+) from NJ since May 2007. Dixon Mills Apartments had been accepting this subsidy since that time to the present. It was paid directly to the landlord. This subsidy was always paid on time. However during the June 9, 2008 conversation with the rental office they informed that the HOPWA check was sent back to Cornerstone (the agency that provided my HOPWA subsidy). Again, no notices were given to me that Dixon Mills Apartments would not be accepting my rental subsidy any longer. This meant that I would be responsible for $1600 in rent. I asked the rental office if the amount were paid in full would I be able to stay. She replied no.

On June 9, 2008, I then went to Cornerstone and told them of what was happening. They callously told me to go to Legal Services. No other offer of assistance including relocation assistance was offered to me.

I find it hard to believe, as well as morally wrong that a landlord can stop accepting a rental subsidy without any advance written notice. A rental subsidy that they had accepted for 13 months without question.

Item 9 on the contract addendum that me, Dixon Mills and Cornerstone signed stipulates that 30 days notice must be given to Cornerstone by either the tenant or landlord should either party decide to end the agreement. Again to my knowledge no 30 day notice was given.

I was forced out of my apartment on Thursday, June 12, 2008
