We are having a problem getting our landlord to come fix a FLOOD that started 08/22. Our apartment has flooded almost everyday since then (currently 09/10- floor is SATURATED, water POOLING around our feet!!!). Flooding to the point of MOLD growing. I have been unable to find ANY GOVERNMENT agency to help us. Landlord is now retaliating against us for contacting the fire marshal and our insurance co. She REFUSES to come fix the leak until "we are out of this apartment." Our lease isn't up until Oct 31st. I don't see why we should have to move 2 times in that amount of time. I had to threaten to get an attorney before she even agreed to give us some money to move since NONE OF THIS IS OUR FAULT!!! We have called daily and we have yet to get ANYTHING resolved. $200.00 is not enough to have to move 2 times in less than 60 days. Especially since she didn't even offer this until 09/07. Mind you, this flood began 08/22. They neglected to even come look at it until 08/24. I have missed time from work in order to call them REPEATED until they came to even look at it. We have NOWHERE else to turn. I have tried WLTX, the STATE, DHEC, Housing Authority, Consumer Affairs, EPA, the Fire Marshall, the Governor's office, the Richland Co. Ombudsman office as well as the City of Columbia ombudsman office. Why is it legal for a landlord to REFUSE FLOOD MAINTENANCE OR TO CLEAN UP MOLD AND TENANTS HAVE NO RECOURSE, MUCH LESS ANY OPTION OTHER THAN TO BE FORCED OUT OF OUR HOME? Not only that, the landlord was willing to renew our lease and now REFUSES to do. She didn't refuse to renew until AFTER we contacted the Fire Marshal who didn't do anything but come look and take a couple of pictures. She told him she was fixing the leak and he was content with that. However, 2 weeks later the flood is still flowing like a river in our apartment. My insurance company has deemed the apartment uninhabitable due to possible dangerous mold. We don't know what type of mold is in ABUNDANCE as we can find no one that will test it. DHEC says they will not come into a private residence. The landlord is now forging documents and dates in attempts to support her claims. However, we have documentation showing otherwise. HELP! We are up against a slum lord! I know we are not the first people they have done this to, nor will we be the last if they continue to get away with this. No one should have to move into an apartment with a mold problem that the landlord REFUSES to clean, much less correct in a proper and permanent manner. I hardly think spray painting "Kilz" over the mold and using a 1 gallon shop vac qualifies as a suitable cleaning of potentially dangerous mold.
